Shoot 360 Nation LLC (“Shoot 360,” “we,” “us,” and “our”) respects the importance of the privacy of your personal information.  For purposes of this Privacy Policy, “You,” refers to any person who uses this website, or interacts with us in connection with our products, services or programs, including a minor participant of the services whose parent/guardian has completed an activity sign-up on the Site or 360 App. 

We provide this Privacy Policy so you know about our information handling and storage practices and understand how we collect, use, and share the personal information we receive about you from your use of the website on which this Privacy Policy is posted or referenced (the “Site”), or otherwise in connection with our mobile application (the “360 App,”) or the products and services, which could include information received from other sources including our franchisees and licensees.  By accessing or using the site or interacting with us, our franchisees or licensees, in connection with Shoot 360r products, services or programs, you agree to the terms of this Privacy Policy.

Your visit to the Site, use of the 360 App or Shoot 360 products or services, and any dispute over privacy is subject to the Terms & Conditions and this Privacy Policy.  Use of any of the foregoing is strictly voluntary.  If you do not agree to our Privacy Policy and Terms & Conditions, you must immediately log off the Site and refrain from use of the Shoot 360 App, which we request you immediately delete.  If we find that you ae continuing to use these items we may terminate your access to the site or use of the 360 App.  Additionally, we may not be able to assist you in connection with matters relating to our products, services or programs.

Important: This Privacy Policy applies to Shoot 360 Nation LLC corporate operations.  Shoot 360 Nation LLC franchisees and licenses are independent entities, and their processing of information is subject to their own privacy policies.  For information on how a specific Shoot 360 Nation LLC franchisee or licensee processes your information, please direct your request to that Shoot 360 Nation LLC franchisee or licensee.

Privacy Policy

Your privacy is critical to us and it is important that you understand our practices and procedures regarding our use before disclosing information. The following privacy policy explains these practices and procedures, to which you agree by accessing our site and services.

1. Your Consent

BY SUBMITTING YOUR PERSONAL INFORMATION TO US (EITHER DIRECTLY TO US OR INDIRECTLY THROUGH ONE OF OUR SERVICE PROVIDERS), YOU ARE CONSENTING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION IN THE UNITED STATES AND TO OUR USE OF YOUR PERSONAL INFORMATION AND ANY RELATED INFORMATION IN THE MANNER DESCRIBED IN THIS PRIVACY POLICY, INCLUDING THE TRANSMISSION TO, AND STORAGE AND PROCESSING OF YOUR PERSONAL INFORMATION BY THIRD PARTIES WHO MAY BE OUTSIDE THE UNITED STATES.

IF YOU ARE SUBMITTING PERSONAL INFORMATION OF THIRD PARTIES TO US, YOU WARRANT AND REPRESENT YOU HAVE THEIR CONSENT TO PROVIDE THEIR PERSONAL INFORMATION TO US AND YOU WILL INDEMNIFY US AND HOLD US HARMLESS FROM AND AGAINST CLAIMS BY SUCH INDIVIDUALS RELATING TO OUR PROCESSING AND USE OF SUCH PERSONAL INFORMATION WITHIN THE TERMS OF THIS PRIVACY POLICY.

2. The Data We Collect

Personal InformationPersonal Information” is information that allows us to identify you. The types of Personal Information that we may collect from you through your use of our Site, the 360 App, and Shoot 360 products or services may include, without limitation, your name, address, e-mail address, phone number, height, weight, performance data of a player utilizing the services (“Player Data”), and date of birth. We collect Personal Information from you in a variety of ways, including when you complete a form, visit a Shoot 360 facilities, use the 360 App, provide feedback, or interact with our digital and social media content.

If you do not provide the mandatory information for a particular activity, you will not be able to engage in that activity. We may also limit your ability to use all or a portion of the Site or the services. If you are a registered user of the Site, we may track when and how you use the Site and the operations you perform on the Site.

Anonymous Electronic Information. In general, you can browse the Site without telling us who you are or revealing any personal information about yourself.  However, we collect your computer’s or mobile device’s IP address, which you necessarily disclose when you visit the Site so that data (such as the web pages you request) can be sent to your computer or device.

Cookies. The Site may utilize “cookies,” which are text files placed on your computer or device that web pages or screens may use to store data on your computer or mobile device or send data to our web servers.  These files typically contain information about your visit to our Site, as well as any information you’ve volunteered such as your name and contact information.  We may use cookie data to “recognize” you when you return to the Site, to save your user ID, to track usage information, to troubleshoot how the Site operates, and for internal analysis of how people use the Site.  Cookies help us understand how our Site is being used and to improve your user experience.  Should you decide not to accept cookies from the Site, you will limit the functionality we can provide you. 

 

Additional Electronic Information.  We may use standard Internet technology, such as web beacons, tracking pixels, and other similar tracking technologies, to track your use of the Site.

 

Location Information. We may collect information about your location if you provide your address or zip code, indicate your preferred store locations or we may approximate your location based on your IP address.

 

The Site is not designed to respond to “do not track” requests from web browsers.

 

Through Your Interactions with Us.  When you engage in certain activities on the Site or otherwise interact with us, such as by using the Contact feature on the Site, by responding to surveys and feedback requests, providing requested information, making a purchase on the Site, using the 360 App, or inquiring about a franchise, we may ask you to provide personal and other information. 

 

The information we will require will depend on the activity and could include your name, email address, contact number, home address, and payment information. If you do not provide the mandatory information for a particular activity, you will not be able to engage in that activity. You may also limit your ability to use all or a portion of the Site. If you are a registered user of the Site or the 360 App, we may track when and how you use the Site and the 360 App and the operations you perform on the Site and/or 360 App.

 

Information Obtained from Other Sources. We may obtain information about you from other companies and organizations, such as from our franchisees, licensees and service providers that may perform certain operations on our behalf. We process information received from the franchisees and licensees to provide them with services as well as for our own purposes in accordance with this Privacy Policy. We may combine information received from other sources with information we have collected or may collect about you. We may also collect information that is publicly available. For example, we may collect information about you when you interact with us through social media. When using certain third-party social networking services (e.g., Facebook, X), you may have the option to share your Social Network information and activity with external sites (including Shoot360.com). Information we may access about you, with your consent, from a Social Network may include, but is not limited to, your basic Social Network information, your location data, your list of contacts, friends or followers and certain information about your activities on the Social Network. If you permit a connection between a Social Network and a service, we (and that Social Network) may be able to identify you and to associate information received pursuant to the connection with information we already have about you. For more information, please review the privacy disclosures and terms of your Social Network account, which govern how that account information is collected and shared with us. We are not responsible for the accuracy of any information provided by other sources or the data practices of other sources.

 

3. Use and Disclosure of the Data We Collect

 

Generally, we process and use personal information to provide and improve our products, services and programs, including the Site and the Shot 360 App, for purposes in our legitimate interests and for compliance with applicable laws.

To Operate Our Business.  We process personal information where:

a) you have given consent to the processing, either to us or to our service providers, partners, franchisees or licensees;

b) processing is necessary to perform a contract with you;

c) processing is necessary for the purposes of the legitimate interests pursued by us or a third party; or

d) processing is necessary for compliance with a legal obligation.  Some of our lawful bases for processing your information stem from our independent franchisees and licensees.

We may use your personal information, including Player Data, for particular business activities, including, without limitation:

•  Providing products, services and programs directly to you or via our franchisees or licensees

•  Contacting you regarding Shoot 360 products or services

•  Providing you with information you have requested, or products or services you have signed up for

•  Administering your participation in a contest, sweepstakes, promotion, survey, poll or vote

•  Sending you promotional material or special offers

•  Customizing or personalizing ads, offers and content made available to you based on your usage of the Services and analyzing the performance of those ads, offers and content, as well as your interaction with them

•  Responding to your inquiries

•  Managing your account and service history

•  Processing your orders

•  Marketing and research

•  Processing your franchise application

Depending on the circumstances and the nature of the information, we may share this information with our affiliated entities, with Shoot 360 franchisees and licensees, marketing partners, and other parties with whom we collaborate. For example, we share information with franchisees and licensees in order to provide consistent customer experiences across the Shoot 360 franchise network, respond to your questions and comments, market and advertise to you, and otherwise comply with applicable law.

In order to administer the services, we may share your information, including mobile phone numbers, with third parties including without limitation: hosting providers, data management companies, address list hosting companies, e-mail service providers, analytics companies, distribution companies, fulfillment companies, payment processors, operational partners, business partners, and marketing partners.

To Improve our Business.  We may use your IP address and similar Site use information to:

a) help diagnose problems with the Site/360 App, administer and improve the Site/360 App, and measure the use of the Site/360 App;

b) identify the type of web browsers used, the pages viewed, the websites from which a visitor found the Site, and the search terms and search engines used to find the Site; and

c) gather other analytics information relating to use and navigation of the Site/360 App.

This information does not identify you personally. On occasion we may aggregate this data with data from other users to track overall visitor traffic and usage patterns and provide this aggregate information to vendors, business partners, or affiliates.

The information we obtain using standard Internet technology, such as web beacons, tracking pixels, and other similar technologies, enables us to customize the services we offer visitors to the Site, to deliver targeted content, and to measure the overall effectiveness of our online content, advertising, or programming or other activities.

We may use your location information to provide personalized content and advertising, to enhance your experience with the Site, to assist us with analytics, to improve our services and operations, to train our staff and franchisees, and to improve the effectiveness of our Site.

We may use the information in an anonymous or aggregated format that does not identify you personally, which uses might include, without limitation, to evaluate existing products, services, and systems; to assist in the development of new products or services; research; advertising; and to identify trends and changes.

For Law Enforcement, Regulators and Other Parties for Legal Reasons. We may also disclose personal information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by law, rule, or regulation; (b) to protect and defend our rights or property or those of our affiliates, franchisees, licensees, business partners, or others; or (c) as we, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

 

In addition, since our database is a business asset, in the event we are reorganized or become part of another organization, you consent to the sale, assignment, or transfer of your personal information to a successor that acquires substantially all of our business assets, or to an affiliate, as applicable.

 

We do not sell personal information to third parties. Other than as set forth in this Privacy Policy, we do not transfer, share or disclose personal information to third parties.  We do not disclose personal information of individuals we know to be under the age of 16 to other businesses or third parties for consideration except as noted above.

 

4. SMS Consent & Communications

SMS Opt-In & Communications. When you provide your mobile phone number and consent to receive SMS messages, we use your number solely to communicate information related to Shoot 360 services, including appointment reminders, account notifications, facility updates, program communications, and promotional messages where you have separately opted in. Consent to receive SMS messages is not a condition of purchase. 


Location- and Platform-Specific Messaging.  Shoot 360 operates multiple independently owned and operated facilities, each of which may use separate SMS messaging platforms. Your consent and any opt-out request apply only to the specific facility and messaging platform from which the message was sent.  If you have opted to receive SMS messages from multiple locations, you must opt out separately from each.

Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying STOP to any message. For assistance, reply HELP. 


Mobile Information Sharing.  We do not sell, rent, or share mobile phone numbers collected for SMS communications with third parties for their own marketing purposes. Mobile numbers may be shared only with service providers who assist us in delivering SMS messages and are contractually obligated to protect the information.

 

5. Google Analytics

We may use a tool provided by Google called “Google Analytics,” to collect and process information about your use of the Site. Google Analytics collects information such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. We use the information we get from Google Analytics only to improve the Site. Google Analytics only collects the IP address assigned to you on the date you visit the Site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information.  Google sets and reads cookies to collect this data and your web browser will automatically send data collected by those cookies to Google. Google uses this data to provide us with reports that we will use to improve the Site’s structure and content. You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser. However, this may impact your use and enjoyment of the Site.

 

6. Targeted Advertising

We also may share your information with the following platforms to provide personalized advertising and analytics:

· We may use a tool provided by Google called “Google Ads Customer Match,” to target ads …

· We may use various tools products provided by Meta Advertisements that require us to share your information to specific customers when they’re browsing on Google Search, YouTube, and other platforms. We only share with Google information that we collect directly from you through our websites, mobile applications, physical stores, and other situations where you have shared information directly with us. To keep your information data secure, Google Ads will put data through a process called “hashing.”  Hashing is a process that generates a value from input text using a one-way algorithm. This one-way function means it is nearly impossible to determine the original input if only based on the hash code. By providing your information to us, you consent to our use of Customer Match. For more information on how Google uses this data, visit Google’s Personalized Advertising Policy. To opt out of personalized advertising, or to tailor your Google advertising settings, please visit Google Settings for Personalized Ads or contact us by submitting a request as set forth in Section 9 of this Privacy Policy.

  • We may use various tools products provided by Meta Advertisements that require us to share your information. In particular, we use “Meta Pixel”, a tool that allows us to measure, optimize, and build audiences for our ad campaigns. Meta Pixel Analytics collects information such as IP addresses, the pages you have visited, and or details of products you have purchased from our Site. We use this information solely for targeted advertising, analytics, and for improving your experience. We use Meta’s “Custom and Lookalike Audiences” tools to find existing audiences across Meta technologies. Custom Audiences lists prepared for us by Meta help us understand your browsing patterns to help us create ads better targeted to you. To opt out of personalized advertising, or to tailor your Meta advertising settings, please visit Meta Ads Preferences or contact us by submitting a request as set forth in Section 9 of this Privacy Policy.

7. Children’s Online Privacy Protection

 

The Site is not directed to children under the age of 13 and we will not knowingly collect personal information from children under the age of 13 on the Site, unless we have received consent from a parent or guardian.  If we become aware that we have inadvertently received personal information from a child under the age of 13 on the Site and a parents or guardian has not approved this collection, we will delete the information from our records.

 

8. Security of Personal Information

We take the security of personal information seriously and we take what we believe to be reasonable precautions and have implemented certain safeguards to protect the security of data and personal information. We may transmit your personal data to third parties outside the United States for storage or processing. We will attempt to ensure that your personal information will be subject to appropriate safeguards and that it is processed and secured in accordance with applicable law. However, we cannot guarantee against any loss, misuse, unauthorized disclosure, or alteration or destruction of data or personal information. While we strive to protect your personal information, we do not guarantee the security of any information you transmit to or from the Site or by email or otherwise, and you provide such information at your own risk. You acknowledge that: (a) there are security and privacy limitations in computer systems and on the Internet which are beyond our control; (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the Site, including personal information, cannot be guaranteed; and (c) any such information and data may be viewed or tampered with by a third party while such information or data is being used, transmitted, processed, or stored.

9. Our Relationship to Other Websites

The Site may contain links to other websites. If you visit one of these other websites, we encourage you to review the privacy policy on that website.  We are not responsible for the policies and practices of other websites, and any information you submit to those websites is subject to their privacy policies.

10. Privacy Rights and Requests

Depending on where you live, you may have rights under applicable laws concerning personal information we have collected about you, which may include the right to access your personal information we have, to ask us to delete, correct, or restrict the use of your personal information, to withdraw your consent to our use of your personal information, to ask how we have used your personal information, and to ask whether we have shared your personal information. We will honor your rights to the extent required by us under applicable law or as we may agree to honor in our sole discretion.

You have several controls and choices when it comes to your personal information, including:

· Access: You may request confirmation of whether we are processing your personal information and obtain access to that information.

· Correction: You may ask us to correct any inaccuracies in your personal information.

· Deletion: You may request that we delete your personal information, subject to any applicable exceptions.

· Opt-out:  At any time, you may opt out of the sale of (i) your personal data by Shoot 360; (ii) targeted advertising; and (iii) profiling for decisions.

All communications must be in the English language. Please clearly state what information you are requesting and any other requests you are making. You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

 

We will respond to reasonable requests within the time limits within 45 days of their request. In the event that we cannot respond to your request within such time, we provide you with advance notice of such delay. We will never discriminate against you for exercising your privacy rights.

 

If you or your authorized agent sends us an email requesting that we take action regarding your personal information or the right to be forgotten, the requesting email MUST come from the email address we have on file for you in order to verify that the request is valid and also to protect your personal information. All other requests must be made in writing or otherwise be verifiable as originating from you or your authorized agent. In order to protect your information and because people may have the same name, we will only provide or delete personal information that we can verify is associated with your particular email address or where we can reasonably identify the identity of the requestor.

 

For your protection, we may ask you for additional information to verify your identity. In most cases, we will provide the information you request and correct or delete any inaccurate personal information you discover. We reserve the right, however, to limit or deny your request to the extent permitted by applicable law if: (a) complying with the request may present a threat to the personal safety, property, or rights of any other person or organization; (b) complying with the request may lead to a violation of applicable laws or regulations; (c) we are not required to comply with the request because of a legal rule or exception; or (d) you have failed to provide us with sufficient evidence to verify your identity.  We will not delete personal information if that personal information is related to an ongoing transaction.  Even after a request, we may also keep personal information where necessary to comply with applicable laws or where necessary to protect a legal right or fulfill a legal obligation.

 

Users may delete their account and associated data by logging into the Shoot 360 mobile application and selecting Remove Account in the My Profile section, or by submitting a request through https://www.shoot360.com/contact.

Please note that Shoot 360 franchisees and licensees are independent entities, and their processing of information is subject to their own privacy policies. If you wish to exercise any of these rights with respect to the processing of information by Shoot 360 franchisees and licensees, please visit your local independently-owned and operated location to effectuate your requests, and we will work with the franchisee or licensee to address your request to the extent required by applicable law.

 

11. How Long We Keep Personal Information

 

We store the personal information we collect about you for as long as is necessary for the purpose(s) for which we collected it, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

 

12. Changes to Privacy Policy

 

We reserve the right to revise this Privacy Policy, in whole or in part, at any time without notice to you. You expressly waive any right to receive notice of any revisions to this Privacy Policy. We encourage you to review this Privacy Policy regularly in your use of the Site to ensure you are aware of current practices. Any use of the Site following the date on which the revised Privacy Policy is published on the Site shall constitute your acceptance of all such changes.

If you are a California resident, you may exercise the following rights (subject to certain limitations at law) conferred by the CPRA in relation to the personal information that Shoot 360 has collected about you.  You have the right to:

  • request the deletion of your personal information collected by Shoot 360 and to request Shoot 360 tell its corporate affiliates, franchisees, licensees, marketing partners, service providers and other parties to do the same;

  • opt-out of the sale of your personal information by Shoot 360;

  • request that Shoot 360 disclose what categories and specific pieces of personal information about you that Shoot 360 has collected, used, disclosed, and sold during the last 12 months;

  • not receive discriminatory treatment by Shoot 360 for your exercise of privacy rights under the CPRA;

  • correct inaccurate personal information that Shoot 360 has collected; and

  • limit the use and disclosure of sensitive personal information that Shoot 360 has collected.

Personal Information

If you are a California resident, the term “Personal Information” as used in this Privacy Policy means information that identifies, relates to, describes, or is reasonably capable of being linked directly, or indirectly, with, an identified or identifiable person or household whether such data is in individual or aggregate form and regardless of the media in which it is contained, including, but not limited to, an individual’s name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.  Personal Information does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

CPRA Sensitive Personal Information Disclosure

The categories of data that Shoot 360 collects and discloses for a business purpose does not include “sensitive personal information” as defined under the CPRA. 

Sale of Personal Information

Shoot 360 does not generally sell personal information as the term "sell" is traditionally understood.  However, to the extent Shoot 360 sells your personal information as the term "sell" is defined under the CPRA, you have the right to opt-out of the sale of your personal information by Shoot 360 to third parties at any time by submitting a request as set forth above in this Privacy Policy. 

Notice of Collection of Personal Information

We describe the personal information we collect, generally, earlier in this Privacy Policy.  In Table 1, below, we list the personal information falling into categories established by the CPRA that Shoot 360 collects or has collected specifically from California residents in the 12 months preceding the “Last Updated” date of this Privacy Policy.  Shoot 360 collects and uses these categories of personal information for the business and commercial purposes described above in Section 3 of this Privacy Policy.  The business purposes necessitating the collection of each category of personal information is also included Table 1 below.

Shoot 360 may also use the information collected for its own other operational purposes, purposes for which it provides you additional notice, for purposes disclosed elsewhere in this Privacy Policy, or for purposes compatible with the context in which the personal information was collected.

Categories of Personal Information Disclosed for a Business Purpose

We describe personal information that we disclose for business purposes, generally, in Section 3 of this Privacy Policy. In that section we also describe the third parties to whom we may have disclosed the information. In Table 1 below, we list the specific categories of third-party recipients to whom we have disclosed personal information from California residents in the 12 months preceding this Privacy Policy’s “Last Updated” date. 

Shoot 360 does not disclose personal information of individuals we know to be under the age of 16 to other businesses or third parties for consideration.
